INVESTMENT CONSIDERATIONS

Investment Considerations supplements and is incorporated into the Terms of Service Agreement.

All trading and investment involves a high degree of risk, which leads to risk of loss. The following is a discussion and some examples of risks of loss. You acknowledge it is your obligation to take additional steps and learn more about the risks and investment considerations relating to any particular investment, including any trading and investment discussed in Content.

Users of the Services, including Publishers, may own stocks or products they discuss in the Content and that may create an incentive for them to promote the stock or actions related to it.  They also may have relationships with broker-dealers or other third parties, and those relationships may provide financial incentives or otherwise create conflicts of interest when the parties are submitting Content. Tradewith requests Users disclose relationships that create conflicts of interest but Users, including Publishers, may fail to make those disclosures or the disclosures may be incomplete, inaccurate, obscure or otherwise ineffective. Tradewith, for itself and its Affiliates, disclaims all liability for actions or inactions of any third parties, including all Content providers such as Publishers.

Tradewith, in any capacity for which it provides Services, including submitting Content or acting as a Publisher, provides information and takes actions so Users will use the Services. Tradewith may have relationships with broker-dealers that benefit Users and for which it does not receive any compensation, but for example, the relationships may help Tradewith increase the number of Users or the User’s use of the Services. Broker-dealers may increase their trading volume or other transactions for which they receive income and profits.

The following risks and many other risks of loss are associated with every security, option, product, strategy, trading program or other investment. There are frequently sharp differences between the anticipated profits and the actual results achieved.

Tradewith’s Content is intended to relate to securities. As set forth in the Agreement, Tradewith is not, and it does not require any Users, including any Publishers, to be licensed as investment advisers, broker-dealers or otherwise licensed or regulated to be providers of investment services, instruments or products. Licensed broker-dealers are authorized to offer and sell securities and offer their customers the ability to trade and invest in securities and other investment instruments through regulated brokerage accounts.

Also as set forth in the Agreement, the Content is not, and is not intended to be, tailored to any specific person or individual circumstances. Licensed investment advisers offer and sell investment advice that is designed for an individual and his or her circumstances. These are not the types of parties typically providing Content on Tradewith.

Licensed broker-dealers and investment advisers provide their customers with risk disclosures and other important information. The U.S. Securities and Exchange Commission (https://www.sec.gov/ ) regulates broker-dealers and investment advisers. The Financial Industry Regulatory Authority (https://www.finra.org/#/ ) also regulates licensed broker-dealers. You may find and review the disciplinary history of a licensed broker-dealer on Brokercheck (https://brokercheck.finra.org/ ). You may look up information regarding registered investment advisers on the [IARD (https://adviserinfo.sec.gov/ ). State authorities also may regulate broker-dealers and investment advisers.

In addition to securities, other investment products, such as commodities futures, foreign exchange products, binary options, and cryptocurrency have different risks and generally are viewed as higher risk products. Additionally, those investment products and their providers may be regulated by different government and regulatory authorities, including the U.S. Commodity Futures Trading Commission (https://www.cftc.gov/ ) and the National Futures Association (https://www.nfa.futures.org/  ).  If you encounter Content relating to investments, products or strategies that involve non-securities or non-security options, you may notify Tradewith at notify@tradewith.co.

Specifically with respect to Tradewith’s Content that relates to investments made by certain hedge funds and any Services related to it, the information provided is hypothetical performance results that are prepared with the benefit of hindsight. Tradewith’s study and related Services, including Content such as a Tradewith portfolio, is based on past performance. A hypothetical trading record cannot completely account for the impact of financial risk in actual trading, such as the ability to withstand losses, and that and numerous other factors, such as the fact that third parties may engage in different analysis and have extensive research or other information they rely upon, and the investments have not been traded together in the manner shown, all of which can adversely affect actual trading results. Keep in mind that there are not actual allocations of specific investments to compare to the performance results from the hypothetical allocations and you should be wary of placing undue reliance on these results. These considerations apply to any User or Content providing you with hypothetical models or information that has the benefit of hindsight.
